FAQ

Answers, before you ask.

Everything Chilean professionals most frequently want to know about the H1B1 and how we work.

What is the H1B1 visa?

+

The H1B1 is a specialty-occupation work visa created under the Chile–United States Free Trade Agreement, reserved exclusively for Chilean and Singaporean nationals. It sits outside the H-1B lottery and does not require a USCIS petition.

Do I need to participate in the H-1B lottery?

+

No. The H1B1 has its own annual quota of 1,400 visas reserved for Chile and is processed directly through consular channels — no lottery, no USCIS petition.

How long is the visa valid?

+

The H1B1 is granted for up to one year initially and can be renewed annually with no maximum number of renewals, as long as the specialty employment conditions are maintained.

What are the basic requirements?

+

Chilean nationality, a bachelor's degree (or equivalent) related to the specialty occupation, a U.S. employer offer, and an approved Labor Condition Application (ETA-9035) filed by the employer with the U.S. Department of Labor.

How long does the process take?

+

Once the LCA is filed, DOL certification typically takes ~7 business days. The consular interview at the U.S. Embassy in Santiago is scheduled by availability, and the visa is generally stamped within 7–10 business days after approval. Total: usually 4–8 weeks.

Can my family come with me?

+

Yes. Spouses and unmarried children under 21 are eligible for the H4 dependent visa.

Do you guarantee a U.S. job offer or visa approval?

+

No serious advisor can guarantee either. Visa outcomes depend on the sole discretion of U.S. authorities, and hiring depends on the market and your profile. What we guarantee is a rigorous strategy, real access to our sponsor network, and end-to-end execution.

Are you a law firm?

+

No. JAQ Minerals is a private consulting firm. Any work requiring the practice of law is performed in coordination with duly licensed U.S. attorneys.

What professions typically qualify?

+

Engineering, information technology, finance, healthcare, architecture, sciences, education and other roles that meet the U.S. definition of specialty occupation and require at least a bachelor's degree in the relevant field.

What does your service cost?

+

Fees depend on the scope: assessment, positioning, sponsorship search, filing coordination and relocation. After your intake call we send a written proposal with fixed milestones.
